    I work for a big company. Each time when I move to a new project, my company ask me to file an LCA and H-1B amendment for new project location. It takes several month to get approval until then you have wait and face all travel restrictions.
    I know that several smaller companies don�t file such amendments

    Does anyone who why do we have to file such amendment?
    What happens if we don�t file this?

    Hi Guys,

    Just need an advice to what to do. My wife is currently on F1 and she is graduating in Dec'07.She has and EAD and AP since we applied for her I485 and even mine is pending. Now I have apply for her 7th year H1B extesion.So my question is do we need to even apply for my wife status change from F1 to H4.She is planning to use her EAD.

    lets say even if we apply for status change now, can she travel on AP even though status change is pending.

    Current EAD was supposed to expire in Feb so applied 100 days ahead for renewal. To my surprise application got approved in 10 days:D. Hope they've given for 2 years and starting from expiry date of current one....

    I have just received an email from CRIS that my I 140 has been approved.Good luck to everybody.

    PD: Dec 2005
    1st I 140 approval date: June 2006
    Concurrent filing I 140 and I 485 applied on 6th August 2007
    2nd I 140 approval date: 30th April 2008

    Hi, guys:

    My friend filed I-140 and I-485 concurrently on 8/6/2007. His lawyer just got a rejection letter (not RFE) from INS due to the I-140 filing fee problem: The expected filing fee is $475 and the check in his filed package is $425. It is a $50 different. Does anybody have the similar situation as my friend ? And
    how do you guys handle this prolem ? Any suggestion is appreciated.

    Hi,

    I've been working full-time on EAD for the last 2+ years. I have a pending 485 application, on which my spouse is the primary applicant. I have never applied for H1B in the past, because I transferred directly from F1 (student visa) to this EAD.

    My spouse also has an H1B, which is in it's 7th year (completed 6 yrs of H1B).

    My spouse has been put on furlough (unpaid leave) for 3 months.
    What are our options ?

    1. Can my employer file H1B for me, and an H4 for my spouse ? How will this affect our green card application (on which my spouse is primary applicant) ?

    2. How much time does my spouse have to look for another job (with similar job description), without being out of status ? Is there some grace period associated with H1?

    E. APPLICABILITY OF INA SECTION 202(a)(5)(A)AS IT RELATES TO THE ALLOCATION OF “OTHERWISE UNUSED” NUMBERS

    INA Section 202(a)(5)(A), added by the American Competitiveness in the 21st Century Act (AC21), provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter then the otherwise unused numbers may be made available without regard to the annual per-country limits. This provision helps to assure that all available Employment preference numbers may be used. In recent years, the application of Section 202(a)(5)(A) has occasionally allowed oversubscribed countries such as China-mainland born and India to utilize large quantities of Employment First and Second preference numbers that would have otherwise gone unused.

    If spill over has to happen every quarter as per the detail in above statement, why USCIS is not doing quarterly spill over, it looks like they are still doing annual spill over in to EB2 I and C. My question is am I interpreting the law correctly.Thanks for your help.

    hi gurus, a question.

    I am currently out of US but working for same company in Europe

    I have approved 140, but waiting for PD to be current - (Jan/03, EB3-I).

    I am now a sr manager and seem to be eligible for EB1C (if company agrees).

    Option 1)
    - continue to stay in Europe and apply for 140 (eb1c)+CP
    - while waiting for 140 approval, am i eligible for: EAD and AC21 (after 180 days)

    Option 2)
    -move to US on L1 visa and apply for 140 (eb1c) + 485

    Option 3)
    - wait for PD for eb3 application to be current

    Hope the above makes sense.

    Can you pls suggest the best option & approx 'how much time' it will take for option 1 & 2. (understand option 3 is unpredictable).

    Alternative is invoke AC21 to a know company, who can support your feature GC and continue to work to any employer by transferring your H1B.

    I just spoke with Xiyun Yang from Washington Post and conveyed thanks for covering a detailed article. She expressed that there is attention being drawn by many quarters including political for "Skilled LEGAL Immigrants".

    Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30). Is this the penalty to be legal ?

    The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.
