Yes, we need more help from the media. That is why we have the media event - press conference on Tuesday June 8th. We need members to be there to show a good representation of EB-Community. Apart from that we need to send these emails/letters to media and the reps in 1000's everyday, so that we get the attention we deserve. Thank you everybody that is participating and sending emails every day. We can also print out and send letters.

Ofcourse, if Republicans also voted yes, CIR would have passed.
For me it's simple, majority of Republicans are anti-immigrant while majority of Democrats are pro-immigrants. The vote can speak for itself.

Nola, your intentions are good, but I do not agree with your conclusion. You are biased against yourself and other applicants.
1. who, applicant or cis, is required to make sure gc process is properly followed?
2. also, if someone goes thru' "pain of gc revocation" due to cis error, isn't it ethical (and legally required) to provide "ead/ap" (so person can continue to work and feed his family, be in status), "reinstatement of (again) pending 485" etc. to that person by cis?
3. are these legal & ethical norms only applies to one party or both parties involved in this process?
I understand what you are saying. Both, the applicant (or applicant's attorney) and CIS shold follow the correct procedure. However, there should be no elation to getting a GC when the PD is not current, hence there should be no distress for its "revocation" - which again is a matter of semantics, there is no GC, hence there is no revocation.
I commented on what the applicant and the applicant's attorney should do based on what is ethically and legally appropriate. I did not comment on what USCIS may or may not do to resolve such a situation.
I understand the struggle you metion; I have been in the US since 1994, i lost my priority date of Aug 2002 due to impatience with the backlog center. I started my GC process in 2001! I had a job loss due to Hurricane Katrina. I am married to a US Citizen, but cannot get sponsorship from that marriage due to DOMA. The pity list goes on and on for each and everyone of us. So believe, me, i understand the aspect of "struggle" that each of us has had to endure or is still enduring in order to get a GC.
I don't see how I am biased, especially against myself - that doesn't make sense. I am not an attorney, obviously, but i work very closely with attorneys, well it is essentially my job to work with them and the bottom line in every contractual arranagement or when applying the law, comes down to what are the obligations of the entities involved whether it is a contract or the practical application of the law.

The only positive I can take from this is that it will remove most if not all the US masters degree holders from the general queue.
It may take time but atleast for people such as myself (direct H1B in 1999), we can move up in the queue.
I sincerely hope that IV supports this initiative.

I am new to this and I sent email couple of times and called certain people in IV list.
Most of the responses from the senator/congress members or even conversation refers undocumented immigrants, safe/secure borders etc.
What is missing in representing the EB community different to illegal immigrants ?

I would say your calculations are spot on mate. 10150 is all we will get in Eb3. But if spouses and children are not counted against the cap, then it is truly 10150 primary applicants per year.

our prime minister wants us to come back to India. So his daughter may not be a good candidate for our GC issues.
Don't get me wrong, as the prime minister, he is interested in India progressing and using our talent for that purpose, not the US taking advantage of us.
He should ask his daughter to return to India first...practice what you preach.

Hi,
1. I am on L1 with current company A(with current i-94 expiring in Nov 2007). I got my H1 approval this year from consultant B and they got the I-797B. This document shows the validity from Nov 2007-2010. But I have heard people get something called I-797A which has a new I-94 attached to it and in my case it is not.
Here are my questions.
1. Can I start working for consultant B from Oct 1.(after quitting the company A with L1).?
2. What should I do since I have current I-94 only till Nov 15th 2007 and if I ask my current company A to extend it they wont do because I want to leave them as early as possible before Oct 1st.
3. Can my consultant file for the change of STATUS from L1 to H1B(the approval for which I have already received from USCIS) and then in that case it will have new I-94 attached.
4. Anyother suggestions what should I be doing so that I can start working on H1 after Oct1st here and then whenever I go back to India, after 4 or 5 months I will have the Visa stamped.

A very surprising thing happened in our company today. Shocking it may seem, they laid off 5 employees in my department today without any notice. Today's happenings makes me want to gather as much info as possible in case something unexpected might happen.
I am a July 2nd filer of 140/485 concurrently. No I140 approval yet. Received AP and EAD for both me and my wife.
If I request my employer not to revoke I140, will I be able to use my EAD for my next job?
Can someone give suggestions on what other options I have if something terrible happens to me?

My I-140 is approved and already filed I-485. Finger Printing completed twice and Medical also completed. My PD is Sept 2005 filed at Texas. Texas Processing completed for I-485 shows Sept.2006. This means my processing is completed and now the PD is current can I expect the Green Cards ....what is next??

Mandal ka Kamanadal will do. What this means is that we are back to square one. All the effort, money and energy was spent on making sure that we didnt get screwed any further. Meaning, it hasnt moved us a step ahead but just helped us to retain our positions without going back.
