Guys:
just talked to an IO at Nebraska and was told that my file is waiting for an officer to look at.
When I asked how long will it be before they get to it, she says they have like 500 cases each but that I should be hearing something soon?
Any ideas ...how soon ? Has anyone else had a similar conversation and how long did it take before they heard something??
I know there is nothing definate...but just wanting to share and hear back if anyone had similar experience.

Who decides on the classification of an EB 2 or 3?
I have a masters degree and when filling my residency it was specify in the position, is it something my lawyer should have requested or Immigration decides when they receive the documentation?

Folks,
If your petition has been physically "Mailed" to the Atlanta Service center . Do they give you a tracking number . Can such cases be viewed online on the website http://www.plc.doleta.gov ? How much time does the Atlanta service center take to acknowledge the reciept of such application ?

Hello,
I have a I-485 pending with a LIN# and in the NEW instructions there is a lockbox for "I-485 and MSC" combo and a separate filing address for I-485. I'm confused about where a "I-485 with a LIN#" combo (my case) should be sending his EAD renewal documents over to? (Refering to pages 8-10 of I-765 instructions).

I just checked that Nebraska is now processing cases from August 2007 for I 140 applications. Do these also indicate China and India?
My pd for I 140 is in July, and I am from india. Should I be able to make a query since the dates have gone past my PD?

I am a July filer and have the option of working for a reputable company as expert consultant for 6 months (initial offer). Yates memo indicates that self-employment is possible. Here is my question: Do we need to register a company to be considered self-employed? As a consultant you may not have a customer for while. Isn't it better to register a company if you want to claim self employment? What are the pros and cons of registering a company?

Something new I'm starting. USCIS puts out weekly data on the use of H-1B visas for the 2011 fiscal year which starts in October. I'm going to monitor that for readers and add my own projection on the months the caps are likely to be hit. I have I-140 approved and waiting for PD to become current. Wife , however, is from ROW country and i am looking to applying I-485 for both of us using Cross Chargeability.
Is Cross Chargeability guaranteed to work or do USCIS employees have a discretion if they approve it or not ?
After researching a lot it seems like lot of people have had a hard time in being successful in conveying their CC eligibility to USCIS. What is the difficulty in conveying CC eligibility to USCIS? It seems like people mentioned about their CC in a cover letter to their I-485 but USCIS would miss reading or understanding this information. What is the secret to successfully conveying CC eligibility to USCIS ?

Hi
I just checked my status on line and saw a LUD on my and my wife's pending 485 applications. My priority date is March 2006.
One reason that I am thinking off is that i had a service request opened on 8/22 when i went for infopass appointment and I recd a letter from USCIS dated Sept 30th with the usual template of saying that "we are processing your application bla bl bla and if you dont hear anything from us in 6 months please call us bla bla bla....."
However the LUD is not 9/30 but 10/7. I am wondering if anyone else has seen LUDs on their applications.
My AP and EAD have been renewed long back (about 1 month back).
Any response in this respect is appreciated

I need to get my H1B stamped in Mexico. I know there are some agencies which offer a complete package trip to the Mexico US Consulate. Does anybody know some names and contact information?
I am based in Los Angeles and am pretty close to Mexico border. Do they have something in Southern California? Other places are also Ok.

Hello everyone,
I obtained my F1 visa in Aug,2001 for 5 years and I initially came here for M.S. I have continued for PhD in 2003 and visited India every two years. My F1 expired in Jul,2006 but my I-20 is valid until Dec,2008.The real problem is that I have applied for Canadian PR this Oct and expecting to get it by Oct,2008.
Once I get my PR, I have to go to Canada for Visa stamping and my questions are related to this:
1) Since my F1 expired, Can I come back to US after PR stamping, without needing an F1 visa.?
2) Is it advisable to get my F1 visa stamping in India or Canada next year i.e in Oct 2008, or would it be too late? (since that would be two years after visa expiry).
PS: I wanted to get my F1 stamping only if it were necessary to go to India.
Any suggestions would help me a lot and thanks so much in advance.

I am an analyst under H1B and I am involved in a sales process by developing a prototype for a client. My company wants me to give a percentage of total deal as commission. It will show in the pay stub as commission. Is it legal to get commission under H1B (please remember I am a programmer analyst) ?

seems to say that as long as you have a valid visa (which a greencard is a physical manifestation of an immigrant visa) then you should be ok.
Assuming your son is a US Citizen - he won't need one either.
