Hi,
I need advice from Gurus who have experience or gone through this. I am on H1B with pending I485 and i got married recently. My spouse is on H4.
I have been looking for a job and my employers want to hire me on EAD. If i use EAD, then my wife will be out of status.
Other option is for my wife to get into F1 status.
1. How easy to change the status from H1 to F1?
2. Should i wait to use my EAD till my wife's F1 status gets approved?
3. If the change of status gets denied, will there any problem to her H4 status?
4. Will there be any problem if i add my wife (Assuming she is on F1) to pending I485?

I am applying for an H-1B extension. The prevailing wage determined by icert is less than my actual salary by about $30,000. Will there be a problem if my salary is much higher than the prevailing wage?

My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.I also heard same thing but talking to a attorney is good than posting here..

I have a Masters Degree in the US and the 5 yr experience required for the EB2 also the position requires it; however my lawyer made a mistake and asked for an EB3.
I already received my I-140 and my I-485 was filed at the same time.
What can I do to change to EB2?

Hello There,
I just got an RFE on my 485 as following.
Submit a letter of employment attesting to your current employment. This letter should be written on the company's official letterhead and cite the date you started working, whether the position is permanent and full-time, a description of the position, a description of the position that you currently hold for the company (if any), and the offered salary.
When I invoked my AC21, my new lawyer submitted G-28 but with out any details about my new employment. I hoping that this RFE is related to that. My only concern is that my old job title is programmer analyst and my new job title is Business Solutions Architect with similar (probably a little more) job duties.
Please share your experiences if any one has received similar RFEs.

Two friends of mine were in the same situation.
In both cases dependent children were approved first, then primary applicant
(in one case in a 6 month after his dependent)

My wife is on H1B and she couldnt work for the past 6 months. I applied for my I 140 and I 485 during the July fiasco last year and she was not added as my spouse and we got married at a later date.
Since she didnt receive pay for 6 months, I guess she is out of status for these 6 months. So my question is will this have any effect on her GC process when I add her as my spouse to the I 485 application whenever my priority date become current ? I am really worried and dont want to screw up my GC process after a long wait.

Can you use your spouse's cross-changeability after you have filed for your I-140 already ? How time consuming is this for the USCIS to acknowledge ?
i am quite sure you can...infact you can do this at any stage including after filing I-485.
please verify with an attorney...you will need one to do it correctly.

APs are taking twice as much as EADs. Does anyone has any idea why?

Today after more than a year of calling I was forwarded from NSC to Los Angles office. Looks like NSC CS is offline.
I used to call and narrate my case issues and they would say they emailed or asked me to callback. And my calls went nowhere. Today it got routed to LA office and they listened to my issue and said they are escalating the call and then I got to an officer. He took my case issue and gave me a service request no. NO ONE in Nebraska told me there was something called service request. (though I read about it recently in this forum). I had asked numerous times to the NSC CS how can I track my calls and they said you couldnt.
I think NSC CS should be sued for giving wrong info
