my company might use this one and i have no say on this. just wonder whether the new york office is good in regard to GC process.
FRAGOMEN SUCKS TOTALLY - but unfortunately I got no choice - my employer uses these morons for immigration services. My reasoning is based on my experiences below:
1. I have been mailing Fragomen for 3 MONTHS (YES THREE FULL MONTHS) to initiate my H1 extn 6 months prior to my visa expiry cause I had a need to travel outside the US in a short notice and I did not want to be stuck because of me not having my visa extn papers in time. Despite 5 e-mails and 5 voice mails - there was no response from FRAGOMEN. Escalated this with my company and we had a conference call to discuss this issue with Fragomen. Guess what FRAGOMEN's Client Service Manager had to say when I asked her about they not answering my e-mails and voice mails for 3 months - "I CANNOT ANSWER THIS QUESTION SINCE EVERYCASE IS DEALT DIFFERENTLY AND WE DECIDED TO INITIATE UR H1 EXTN 3 MONTH PRIOR TO UR VISA EXPIRY." WTF!!! Who the hell are they to decide on my professional/personal travel needs? I really wish I had their job - do nothing at all and when questioned say "I cannot answer that question".
2. To make sure FRAGOMEN do not mess up my 485 as well, I asked them in the same call the time they would take to process and file my 485. The client service manager promised me that they would file my AOS in 4 business days from the day they receive all the documents from me. I made sure I sent all the documents including Medical Exam results in less than 2 days from the day we had this call. Guess how long they took to file my case - 3 full weeks - 15 business days!!!!
For the kind of money they charge, the service is totally bad. FRA-DON'T-GO-MEN might be a better name these guys.

If you e-filed and no FP notice then you won't be getting EAD in 90 days.
The day you get FP notice from that at least two weeks after FP will be scheduled. After FP it takes 2 weeks to further processed (Card + approval).
Although USCIS says to contact after 90 days, you should think in terms of getting infopass.
Could anyone else provide some more input?

One way is to invest regularly in 401 K. By that way you let your investments grow tax free and if you have to or go back to India then you can withdraw them next year, TAX free or less tax. Thus you actually pay less tax and ultimately you might pay lesser tax than your social security. Who cares if the social security is being taken from me.
I thought IRS will allow you to withdraw your 401(K) with a 10% fine + all applicable taxes. Not sure how that will benefit someone who is forced to withdraw becuase he has to return to India.

All law firms hired by the employer will only respond or react to employer and not to the employee. Fragomen is very conservative (not 100% ethical) and will not take any chances with GC processing. Employers will always take the law firm's adivice because they dont want to take any risk either. Fragomen represent almost all of the fortune 100 companies, all of BIG4's, BIG 3's and all major consulting firms.
If you (personally) hire Fragomen directly they will respond to all your queries in timely fashion. You will not talk to the lawyer at all. You will only talk to the paralegal. This is the problem with all big law firms.
Again, the prestige of the law firm you hire does not have anything do with your application.

Ok, As promised I am giving you an update I contacted my attorneys office yesterday the most senior attorney was out so I spoke to her assistant and according to him, If USCIS made a mistake then its their mistake not mine once the GC card comes enjoy it and if they realized they made a mistake 3 years from now or 5 years from now well by that time my PD would probably be current so whats the difference. He did recommend I wait longer than 5 years to apply for citizenship buts thats a long way ahead. It just might be my 4th of July gift. :) I will keep you all updated on any changes.

I have said what I have felt. I am not going to be politically correct, never have been. This is not a forum for pracitising genteel speeches, pampering and politically correct messages.
If you RSVP that "I will come" and the host prepares entire day for meeting, makes her daughter skip the extra carricular activities, ends up using better part of weekend for an event she is thinking will be attended by you, but you dont show up even and dont even bother to call they you are cancelling, then you ought to be ashamed of yourself. If you do something like that in your workplace, then you will get fired. If you signup for a volunteer training/conference on behalf of your company, get company to book your travel, make them spend time/money and then on day of travel, you dont even show up at the airport and attend conference/training that you volunteered to attend, then you will get fired. You wont get fired from Immigration Voice and there are no personal consequence to your bad, lousy manners therefore its afforable to do so, and so you can do it.
If you think EAD is the end of the road and you are free now with AC21 options BUT on the contrary you feel more and more need to visit forums here, on Khanna portal, on Murthy's forums/chats then probably you are wrong, you are not free. You are still bound by strings that restrain your mobility and freedom.
LURKERS : And finally, if the only reason (and this is the most common reason) for not volunteering or participating in activities or contributions is that you are afraid of USCIS or some agency retaliating against your pending 485, and the problem is cowardice. The most common reason why we have 3 times more "visitors" then logged in members is that "visitors" are afraid of the government in the most democratic and free country in the world. I need you to login so that I can get email and information about you so that I can seek your help. And I dont need your help for my own personal gain. I am not going to sell you used cars to send you spams and advertisements about something I am selling. I am one of you. Struggling and fighting against an unfair system. Agree with you 100%. I have been waiting patiently all along hoping something good would happen for EB3. I am talking to my employer if they can port my case to EB2. I have a master's degree and about 13 years of experience (8 years in the current job). My only concern is if the new EB2 labor or I140 doesn't get approved for some reason, can I fall back to my current EB3 application. I don't want to jeopardize my current application just by deciding to port to EB2. Any suggestions?
If I were you, I would make it clear to the employer that you qualify for tier 1 in UK and educate them on benefits of tier 1 vs waiting for green card then go from there. It worked for me.

Hey guys,
I am planning to take Infopass to see what more information i can collect.
Also does anybody know if USCIS send courtesy copy of Denial Notice to you as well.
My concern is that my attorney sent G-28 and AC21 both but he feel that since I-485 got denied means they have never updated G-28 or AC21 so it might go to my old attorney.
Does anyone know if i will get courtesy copy of denial notice?

Buddy, if I were you, the first thing I would do is get a good and experienced lawyer on my side and have the lawyer look into these issues. You need a lawyer who has experience in handling such issues.
If you are not using your old lawyer anymore, you should immediately have your current/new lawyer file new G-28 so that you won't have to keep asking your old lawyer for anything. I did change my lawyer once and my second lawyer was able to get everything from my first lawyer.
MTR is no joke and it's worth spending some money on a good lawyer when it comes down to a denial of your AOS application. Good luck to you.

Why H1B, F1, etc.?
Whenever US allows a person/family to come in US on work/study, US should provide equal opportunity to that person/family in most aspects of life (except National Security, Voting Rights, etc. which is after becoming citizen).
If at all any binding required, it could be somthing like six months - not of years and years.

May be you do not know the meaning of three red dots for TheOmbudsman (it used to be two red dots this morning), which is "so many IV members do not like his postings" i.e, TheOmbudsman is "anti-IV"

I'm a South Indian and I have never had issues with Hindi or Hindi-speaking people. In fact, many of my friends are Hindi-speaking and I'm quite well-versed with the language as well (why not?). You cannot make a blanket statement saying that everyone speaking a particular language is rude or has bad attitude. Just goes to show one's ignorance.
Just look around and see what's keeping this country together? You can move from NY to LA without having to think twice. Try doing that back home ;)

It is amusing to see that there are quite a few people who want the very door closed that they used to enter. It is even more amusing to see that the fault is always someone elses. It is similar to all the people who are opposed to immigration because it is someone elses fault that they are losing their job. Down right funny :p.
We need to focus on solving our problems without blaming others for our problems. Because once we go down that lane, we are no better than anyone from NumbersUSA or any other organization/ people who are against immigration. It is OK if we do not support increasing H1B - but saying that the H1B program needs to shutdown is not correct. I am sure that one can reason in the same breath that the EB3 category needs to be eliminated so that retrogression can truely be eliminated :eek:

Bestin: the core is involved. Some of the core are just very busy on IV stuff. I spoke with Aman last week he called me from the airport -- a trip to DC. Some people are cagey about handing out personal details and while it is frustrating let's have some respect. I'm one of the few who puts their full name in signature, and my user id is my name, and I say I'm from NY, so it only takes a telephone directory search to find my phone number and address. But you won't hear me calling people names for not giving contact details. Some people are more reserved than others, for example, my wife used to live in a communist police state where the state was out to get you, so she is more reserved. Frustrating I know. Enough said, let's look for positive things to do.
SO ON THE POSITIVE SIDE:
I got another 33 letters this week, and expect about same next week, and have 2 US citizens who will likely get me another 20. So I might make 100+.
My total in hand so far: 43
I'd be happy to continue for several weeks or months, but will go with what the core decides for drawing the line.

Where you know someone who works at a different place to you ask them to collect some letters from their work place and give them to you or mail them to you. I'm expecting to get at least 20 that way next week alone, maybe more later.
