Lets not get into Apples Vs Oranges debates here. Its ridiculous to stereotype the whole race just coz......bottomline, no one is superior to anyone else, regardless.
If the claim that AF did accomodate 'other' passengers with T visas and not for Indians, that is really so wrong. That we definitely should condemn.

Management announced that our US plant of my division will shut down in next 3-4 years (about 2000 employees). There are no immediate lay-offs but may start anytime,as this is a progressive multi-year transfer to out of country or to a third party.
What is the impact on 485 processing?.
I got an RFE for employment verification a week before the announcement and it was replied. Will there be any issue at the approval stage or in the future?.

Thanks AskBird, My only concern is if the new EB2 labor or I140 doesn't get approved for some reason, can I fall back to my current EB3 application. I don't want to jeopardize my current application just by deciding to port to EB2. Any suggestions?

It seems like the group I am currently working in will shutdown in few months and more than half of the people have left the group already. I, therefore, need to find a job in next 4 months or so. I am a computer engineer by profession but trying to pursue a career in SAP functional field or DBA and looking for some advise from professionals in the field on training requirements/opportunities, career opportunities in different SAP modules, and how to basically get started.

There are total 27 EB3-I approvals on since Oct'2008. In 6 months, only 27 approvals is not a good number.
Does anybody know why USCIS is not touching EB3-I aggressively and are we close to using all EB3-I for this year already?

Yes 27 EB3-I approvals seems pretty low. Hopefully DOS would move EB3-I cut off date in May.

Hi,
Sorry for late jumping on this old topic. But, applied for SSN for my wife and got it in mail. Now what? My taxes for last year were applied in feb this year. How can I tell IRS that my wife got SSN now and she is eligible for Stimulus package?
Can I claim this amount next year when I file my taxes?

You can file an amendment with the ssn information. If you are not sure how, just talk to any cpa.

I called USCIS and she said based on the information she got from his authorities, she said all the 485 application packets will be rejected with a note saying that , please apply after oct 1st if your PD is current.
I also asked her if you dont send us back by oct 1st what sould we do, she said if I dont receive by August mid, then take infopass and go to local uscis office and request for my application back.
I think all the customer service agents are aware of the issue and got informed what to answer for our questions.
That's a relief because I called them a few times recently and found myself having to explain "the issue" to the customer service rep. Ridiculous to have something as major as this happen and they don't properly educate their Customer service department on it.

People feel as if they have achieved something big after getting an EAD. EAD is not a visa and EAD status is not a valid status. You in fact lose your h1b valid status once you invoke AC21.
I have personally seen people change their attitudes as if they have achieved a gold medal in Olympics and talk big about "'Fingerp[rinting", about AC21, as if they have written the AC21 law. Does anyone know how AC21 came into picture on the first hand? There was an advocacy group called "Immigrant Social Network" that was behind the AC21. Prior to that, EB rules were extremely stringent with no portability.
Everyone browses this website, gains knowledge and behaves as if he/she is an immigration expert and has achieved something big.
We have been cajoling people. To what extent?
Words cannot describe the amount of effort "needhelp" has been putting in. She still continues to be the same and claims that her morale will never go down and her commitment levels have increased. All the cowards, and so called smart asses - try to learn some good lessons from people like her.
Life is not all about shopping at Macys, talking about fingerprinting, and watching TV, and spending hours on phones talking about how dealstobuy is different from buy.com or not about how CVS pharma sells the same item for less rate than rite aid. Life is not all about "sitting here doing nothing and talking about how different countries are rising and why one MUST not care for his own good"
IV is a volunteer organization and every member is equally responsible member. If you try to elude, and act smart - it only reflects your dirty character.
If you are here, do something. Yes, atleast something that you feel you can do. Please do not cheat those who are working extremely hard for your cause.

My company went through a 10% workforce reduction company-wide just when my PERM application was ready to be filed. Although nobody from my group has been affected, 2 people with the same job title from a different group in the same office were affected. Their job descriptions are entirely different. I have about a year and a half before my H1B expires. I would appreciate anybody answering the following questions I have:
1. In Form 9089, should the answer to Item 26 be 'No' since nobody in my group or area of expertise was affected?
2. If the answer to Item 26 should be 'Yes', is it sufficient to notify and consider the people laid off? I am confident that they will not qualify for the position. How long should this 'notification and interview' period typically be?
3. I have heard that my company can be sent an audit notice. In such a case, is it sufficent to justify that the area of expertise is different. What is the success rate for this?
4. If the audit response is rejected, what happens then? I have been told that the employee will have to return to his home country immediately and cannot refile his PERM application.

Could not agree more. We are masters of everything related to caste, quotas and discrimination and we need to fix our own house before complaining about other countries, airlines etc.

They will think of themselves only. Characteristics of such peoiple are: Selfish
Instead of celebrating the greater good for all, they are just worried about what they are getting out of it.
These people join a group for security; but will always think only about themselves and will take every opportunity to demoralize the whole team.
We know BEC is an issue and there is sympathy for them, but does it mean we want to stop 700K people with families not getting a chance to better their lives

Got my approval but my spouse hasn't yet received one.
We e-filed it together through the same account. My LIN was constantly getting updated with the status but not my husband. I also received the notification when my application was approved. I got my approval in the mail today too (about 1 month turnaround time) .But we haven't received any notification on my husband's case. And the online status hasn't changed either. Did anybody else face this? Not sure how to follow-up. Any pointers?

I am in the same boat too. But I am not sure if we have a whole 1 month to file 485 based on July bulletin.
The press release by USCIS says that, whoever falls under July Bulletin have the whole 1 month to apply. But if we dont get receipts before July 30th, we may not fall under July bulletin and so we would not be able to apply.
From what I understood, if we get the receipt before jUly 30th,we are good, or else we have to find an alternative to apply before July 30.
