    We need to do something for sure. I know that most of EB3 folks are stuck for GC more than 7-8 years. I don't see any good progress for EB3 in the future.

    I would request from everyone to wake up and take a proactive step. I am ready to give any kind of support.
    The problem is most of the EB3 people are happy with their EAD's. and I guess since EB2 looks promising now - they wont care much about EB3 or retro ..so I dont think anybody is going to wake up. maybe we should go to sleep too :)

    Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?
    Does someone has answer for this?

    If your job profile demands seniority (which it must be - going by your EB3-2003 PD), you are better off refiling under EB2, instead of *just* (read just) spending couple of thousands on IV campaigns and beating up on people who are not contributing as much you have done to IV. That is not to say we stop contributing for the general cause. Don't misunderstand and start flaming at me, won't do any good.

    I have not done this myself with the same employer, I changed my employer for a senior job position and I had also acquired a masters degree in comp engg from a reputed university before I became eligibile for EB2. But as a fellow IVian, who understands the EB3-I issue, I would surely advocate this not only to you but to all other EB3's with older PDs.

    I know you have done a lot for IV.. no body needs to vouch that.. i have seen you in action..but.. i disagree with you on only one thing, calling names.. I understand your frustration, but as a leader you cannot set a bad example... No leader has ever got people to do the right things by calling them names.. while your intent is right, you have done more harm than good by starting this flame war..

    I guess the right thing to do for the texas chapter is to call the members and find out what happened. We have chapter members phone number right?

    I myself was slated to attend the MO chapter meeting, but could not do so and I called the co-ordinator to let her know..

    remember having people skills is not the same as being politically correct..

    I have said what I have felt. I am not going to be politically correct, never have been. This is not a forum for pracitising genteel speeches, pampering and politically correct messages.

    If you RSVP that "I will come" and the host prepares entire day for meeting, makes her daughter skip the extra carricular activities, ends up using better part of weekend for an event she is thinking will be attended by you, but you dont show up even and dont even bother to call they you are cancelling, then you ought to be ashamed of yourself. If you do something like that in your workplace, then you will get fired. If you signup for a volunteer training/conference on behalf of your company, get company to book your travel, make them spend time/money and then on day of travel, you dont even show up at the airport and attend conference/training that you volunteered to attend, then you will get fired. You wont get fired from Immigration Voice and there are no personal consequence to your bad, lousy manners therefore its afforable to do so, and so you can do it.

    If you think EAD is the end of the road and you are free now with AC21 options BUT on the contrary you feel more and more need to visit forums here, on Khanna portal, on Murthy's forums/chats then probably you are wrong, you are not free. You are still bound by strings that restrain your mobility and freedom.

    LURKERS : And finally, if the only reason (and this is the most common reason) for not volunteering or participating in activities or contributions is that you are afraid of USCIS or some agency retaliating against your pending 485, and the problem is cowardice. The most common reason why we have 3 times more "visitors" then logged in members is that "visitors" are afraid of the government in the most democratic and free country in the world. I need you to login so that I can get email and information about you so that I can seek your help. And I dont need your help for my own personal gain. I am not going to sell you used cars to send you spams and advertisements about something I am selling. I am one of you. Struggling and fighting against an unfair system. I need your email - not to sell you fortune cookies - but to ask for funds, ask you to attend local events, ask you to meet lawmakers. None of these things bring a single penny to my bank account. None of these things make my PD current. This is for you, if you think you are up for it. But if you are a coward then no one can help you. And if you are offended by being called a "coward" by me, then you are too coward to even recognize that you are a coward.

    01. If I-140 is revoked by the previous employer after invoking AC12, does the status of I-140 changes? Any LUDs?

    02. How long does it take to revoke an I-140 after the employer sends the withdrawal request?

    I want to ask if I file my labour before oct 2007 am I going to be safe?
    Or I will still come under the merit system?pls anybody will ans this question. I am going to start my GC 2 months(after adv etc)

    You need to file for I-140 before 10/1/07.
    For that you need to have an aproved Labor.
    Bear in mind this is just one of the opinions out there (albeit the most prevalent)
    Nothing is final yet, untill CIR passes both houses and signed by the president before 09/30/07. (Though it looks highly likely now)

    This is America's gift to India. Nasscom should be smiling. Their skilled labor problem is gonna get better with 40-50000 H1s in 6+years forced to leave because of stupid I140>365 days rule.

    Jobs follow skills and outsourcing is gonna rule. They are sending legals/skilled labor out and keeping illegals/unkilled labor in. However advanced a country is the top always attracts the foolish and the emotional. George W bush is the prime example.

    I think the country based quota has been eliminated for the "merit based" quota. Am I missing something.
    The original bill had a 10% per country cap. Don't think that has been removed in the new bill.

    Thank you for sharing with me your support for comprehensive immigration reform. I appreciate hearing from you and share your concerns.

    While the United States cannot afford to absorb all those who want to settle here, we are a nation of immigrants. My mother came to the United States from Lithuania with her parents when she was two years old, and our family created a new life in Illinois. It is a testament to the greatness of this nation that the son of an immigrant can rise to represent the state of Illinois in the Senate.

    At the same time, our nation faces a host of problems as a result of years of inattention to our immigration policies. The Homeland Security Department estimates that about 11 million people in the United States do not have legal status, including those who enter the country illegally and those who overstay a temporary visa. I have worked to reform our immigration system comprehensively and in a way that is tough, realistic, and consistent with our moral values.

    I recently joined a number of Senators in releasing a blueprint outlining the basic principles that a comprehensive reform bill should include. The measure would improve border security by increasing manpower and deploying new technology. It would strengthen enforcement against employers who hire illegal immigrants. Today, undocumented workers are often exploited by employers who hire them. Strengthening the penalties for employers who hire undocumented workers will ensure that both immigrants and citizens who work here are protected by our wage and labor laws.

    If we are serious about reform, we need a realistic approach to the millions of undocumented immigrants who already live and work in our country. We need to offer immigrants who work hard and demonstrate a long-term commitment to be law-abiding, contributing members of our society a chance to pay fines and earn their way to permanent legal status over the course of many years.

    If we do not give people who are already a part of our communities the chance to earn their way to legal status, we will not solve the problem of illegal immigration. People who are living here illegally will stay in the shadows instead of coming forward to register.

    While immigrants often enrich our communities, an employer's first job offer should go to any American who is willing and able to fill the job. I have been concerned about the potential impact of past proposals for temporary guest worker programs on the American workforce. In many industries, the assured availability of large pools of guest workers will give employers an incentive to pass over American job applicants in favor of foreigners willing to work for less pay and fewer benefits. During the immigration debate, I offered a Hire Americans First amendment to require employers to seek American workers for their open positions before they try to bring in guest workers. I have also introduced legislation to combat abuses in the H-1B visa program.

    There is no perfect solution to the problems we face as a result of our broken immigration system. Today, our borders are not secure, our workplace enforcement laws need reform, and our immigration policy fosters a shadow economy for millions of immigrants who simply want to demonstrate that they can be hardworking contributors to the greatness of our country.

    I will continue to work for a package of reforms that will protect American workers and that will be tough, enforceable, economically sensible, and morally defensible. I will keep your views in mind as the debate continues. Thank you again for contacting me. Please feel free to keep in touch.

    All that is being said is very true. Petitioning the US gov't is as American as apple pie. As aspiring Americans we can only be respected for this, if we do it politely and peacefully.

    People who put in a herculean effort (not to be underestimated by anyone here) to organize the rally and surrounding activities, broke their backs trying to lay a platform for the rest of us to communicate our case. It is only natural that when they get the lamest of lame excuses, they feel upset.

    Every one of us has skin in this game. We need to find some way to lend our weight to this issue rather than just passing time on this or other websites. It is really unclear to me why in America, the most free society on the face of the earth, people feel unmotivated, inert, insecure etc to press what is a most legitimate grouse.

    Let me give you a few points that might convince you in this issue. For most of us:

    1) We are here at the behest of our employers or the US Gov't (NIW cases). Not on our own accord or illegitimately.

    2) The US gov't has certified that our jobs do not have suitably qualified americans to take them.

    3) The US Gov't has approved our immigrant petitions.

    4) We are in a period of inordinate delay to complete the steps due to a variety of factors, including bureaucratic delays, inordinately long security checks(BTW bad for both us and the country) and an inadequate supply of visa numbers for the number of approved petitions.

    5) We are asking the US Gov't to fix this issue and treat us fairly and not make us wait 6-10 yrs for no clear reason.

    6) We are asking them to be more straightforward in their policy and to stop sending mixed signals.

    Above all we are doing it in the most American of ways. Peacefully petitioning and lobbying the government. Most broad minded Americans can and do relate to this.

    There is a logical fallacy here. What you are saying is:

    Suppose country quotas exist to limit abuse
    There are country quotas
    Therefore abuse is limited

    The very fact that you are complaining about abuse in the system disproves your proposition.

    it's very easy to make assumptions of how the system works in this country when people want a solution that fits their own particular needs.
    When people have been part of this society for less then 10 years; it is a very, very short time to understand how the system works and the whole history and what goes on behind the scenes.

    I've said this in the past; many people walk around with eyes wide shut. Do some really exhaustive work of the history of immigration; the debates that happened when the laws got created; what has passed, what hasn't; what uscis/ice/dol is doing; request for evidence, denials, consulate refusals; underbidding of contracts, etc.; you may come up with different conclusions then what you may currently believe.

    I am not sure about the statement "There is no corporate support for EB reform.....". Check this link http://www.competeamerica.org/. They seem to have the same agenda as ours (i.e., IV's). Is IV aware (or in collaboration) with them?


    The reason we see progress year after year with Schedule A and nothing happens in EB reform because there is no corporate support for EB reform. This is one of the reaons why we should be open for measure like 485 whenever possible, even after febuary 15th.

    Maybe we need to figure out how we can involve the corporations in EB relief. The only reasons we see Schedule A relief every year because there is a strong health industry lobby driving this. the worst part about this is that these 90,000 and 50,000 which were released last year and they are trying now are comming from the unused\recaptured visas from previous years. there is no country limit in the unused\recaptured visas for Schedule A.

    when it comes to us we cannot get unused visas and added to that somebody always tries to add country limit to even unused\recaptured visas. Its a double whammy for EB retrogression. May god help us.

    I m a new applicant for EB 3 gc born in india.....just starting my process......with my PD being sometime in later half of 2009,do u think canada is a better option?......EB 3 india right now looks like a good 10-12 years wait time!!.......pls advice about canada immigration and is it a viable option?

    No, Canada is not a better option. INDIA!! is a better option. You got to get it out of your mind that you need to go somewhere. It is different in the US because you have some industries and jobs here that you cannot get anywhere else. Also a certian lifestyle. But common Canada, eastern Europe, Africa... you guys are nuts.

    India is a MUCH better option than anywhere else except maybe if you get a real good job in China. As far as I am concerned if nothing happens here I am headed back to my hometown-Bangalore, India.

    I have much better lifestyle and opportunities than Canada or even western europe! Period.
